All items purchased from Createacake are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

APPLICABLE LAW

The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, posted on this site. These policies also govern your visit to Createacake. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Shipping Policy

Sales Taxes

We are required to automatically charge and withhold the applicable GST for orders to be delivered to addresses within Australia. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state or country.

Damaged or Incorrect Merchandise

We will, upon your request, replace any merchandise that is received in damaged condition. No material will be accepted or replacements issued without prior approval to return such merchandise. Filing of claims will be our responsibility.

Po Boxes

Please note that as we use Australia Post we can deliver to Po Boxes.

All orders are sent via Express Post.

If orders are received before 8am Monday to Friday we can gaurantee to most areas throughout Australia next working day delivery, otherwise please allow 2 working days.

REFUND POLICY

Permission to Return and to Receive Credit

We will accept return of merchandise ONLY IF IN SALEABLE CONDITION and notification is within 15 days of receipt .We will Issue Credit to your account or Credit Card in Australian dollars. For unwanted merchandise the cost of return shipping shall be the responsibility of the customer.
